The owner carries out their activity as a natural person, so registration in the Commercial Registry does not apply.

Purpose

xfive.club is the official website of xFive Club, a Spanish esports and content creator club. It publishes information about the club's teams, players, matches, creators and news.

xFive Hub is the club's internal application. Access is restricted to members with an account, and it provides organisation and analysis tools for the competitive rosters. Its use is also governed by the Terms of use.

Users

Access to and/or use of any of these services confers the status of USER, who accepts, from such access and/or use, the terms set out in this legal notice.

Use of the services

The services provide access to content, information and data (hereinafter, "the content") belonging to the owner or to its licensors. The USER is responsible for the use they make of the services and undertakes not to use them to:

1. Engage in unlawful or illegal activities, or activities contrary to good faith and public order.
2. Disseminate content or propaganda of a racist, xenophobic or illegally pornographic nature, glorifying terrorism, or in breach of human rights.
3. Cause damage to the physical and logical systems of the owner, its suppliers or third parties, or introduce or spread computer viruses or any other system capable of causing such damage.
4. Attempt to access or use, without authorisation, accounts, systems or resources of the owner or of third parties.

Intellectual and industrial property

The name xFive Club, its logo, its brand assets, the software of its applications and its own content (text, design, photographs, videos, structure and code) belong to the owner or are used under licence. Reproducing, distributing or publicly communicating this content, in whole or in part, for commercial purposes, on any medium and by any means, without the owner's express authorisation is prohibited. You may share and link to the public website's content, citing its source.

The names, logos and trademarks of games, platforms, tournaments, sponsors and partners belong to their respective owners and appear here for identification purposes only. Counter-Strike 2 and Steam are trademarks of Valve Corporation; VALORANT is a trademark of Riot Games, Inc.; FACEIT is a trademark of its respective owner. xFive Club is not affiliated with, sponsored by or endorsed by any of them.

Exclusion of warranties and liability

The owner takes care to keep the published information accurate and up to date, but does not guarantee that it is free of errors. Match dates, times and results may change at short notice for reasons beyond the club's control.

The owner shall not be liable for damages of any kind arising, by way of example, from errors or omissions in the content, from the unavailability of the services, or from the transmission of viruses or malicious programs, despite having adopted the technical measures necessary to prevent it.

Modifications

The owner may, without prior notice, modify the services, their content and the way they are presented, and may add or remove sections and features.

Links

The services link to third-party sites: the merchandise shop, the brandbook, social media, streaming and video platforms, and gaming platforms. The owner has no control over those sites and accepts no responsibility for their content, availability or privacy practices. Linking to them does not imply any association with the linked entities.

Right of exclusion

The owner may deny or withdraw access to the services, without prior notice, to users who fail to comply with this legal notice or with the Terms of use.

General provisions

The owner shall pursue any breach of these terms and any improper use of its services, exercising all civil and criminal actions available to it in law.

Amendment of the terms and duration

The owner may amend this legal notice at any time, and the amended version will be published here. It shall remain in force until replaced by a new published version.

Data protection

The processing of personal data is governed by Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD). Full details are available in the Privacy policy and the Cookies policy. Use of the services is also governed by the Terms of use.

Governing law and jurisdiction

The relationship between the owner and users is governed by Spanish law. Where the user acts as a consumer, any dispute shall be submitted to the courts of their place of residence. In all other cases, the parties submit to the courts of Málaga.
